Overview
In general, the Court of
Appeals is the highest court in the state and sits in Albany. The Court
of Appeals has limited jurisdiction and generally only hears appeals
from the lower courts. The next level of courts in New York are the
Appellate Divisions of the Supreme Court. The panel for most of the
Western New York area, a region referred to as the Fourth Department, is
located in Rochester. This court also generally hears only appeals from
the lower courts within its jurisdiction. The Supreme Court is the court
of general jurisdiction in the state. Supreme Court sits in each county
and hears both civil and criminal matters. It is the only court that can
grant divorce or annulment. The Court of Claims has jurisdiction limited
to claims against the state. The County Court is similar to the Supreme
Court except the jurisdiction is limited to no more than $25,000.00 in
civil matters. The Surrogate's Court has jurisdiction limited to probate
and certain types of guardianship proceedings. The Family Court has
limited jurisdiction to hear matters involving custody, support, and
juvenile proceedings. The City Courts and Justice Courts hear
misdemeanor criminal matters and civil matters generally not exceeding
$3,000.00 in controversy ($15,000.00 for City Courts). |
